Maintenance, or alimony (as it's commonly referred to), is the obligation to provide financial support to a spouse after a divorce. Maintenance is based on the idea that spouses have a legal duty to support one another during their marriage, and even after their divorce. In Illinois, maintenance is usually given to the spouse who has a significantly smaller income, has serious health problems and is unable to support himself/herself, as well as the spouse that stays home to raise children, while the other one pursues a career.
Different Types of Maintenance in IllinoisPermanent Maintenance - This type maintenance will continue on indefinitely after the divorce. Permanent maintenance is usually awarded in situations where a spouse has significant health problems, or who is too old to work to support themselves. |
Temporary Maintenance - Given to a spouse in need of financial support while in he process of the divorce. Finalizing a divorce may take more than a year. Rehabilitative Maintenance - Rehabilitative maintenance is awarded to a spouse who needs time to become financial independent. Often times these spouses need time to find a job, receive proper training, etc. This especially applies to spouses that have stayed home to watch children. |
