Orders of Protection

An order of protection, or "restraining order" is designed protect an individual from another person, usually in cases of domestic violence.

Criminal Cases for Domestic Violence

When someone performs an act of domestic violence on another, that person is usually placed under arrest. Upon being released from custody and assigned a court date, an order of protection is put into place, to guard the threated individual from the "attacker."

Depending on whether the complaining witness wants to proceed with the domestic violence case, the restraining order attorney will investigate whether a plea bargain is appropriate, and subsequently, the orders of protection case will be set for a bench trial. If the accused is found guilty, the order of protection may be extended for two years.

Independent Orders of Protection

Independent Order of Protection can only be filed against individuals with whom the victim has a special relationship. For instance, spouses, former spouses, parents, children, sibilings, relatives, former boyfriends and girlfriends, etc. An Independent Order of Protection may keep the individual a certain distance away from you, it may keep them out of your home, etc.

Civil Proceedings Order of Protection

An order of protection with regard to divorce or parentage, is very much like an Independent Order or Protection, but the difference is that the proceedings will be before the same judge assigned to hear the divorce or parentage case.
